ABA Formal Opinion 512 (July 2024) requires lawyers to develop competence with AI tools, communicate with clients about AI use, and maintain confidentiality. United States v. Heppner (SDNY, February 10, 2026) went further: a federal court ruled that documents generated using consumer AI without confidentiality protections were not covered by attorney-client privilege.

What Safe AI Workflows Look Like
Safe AI adoption in a PI firm starts with three principles:
Policy first. Before any tool is approved for use on client matters, your firm needs a written policy covering which tools are approved, what data can be input, and what requires disclosure. This isn't optional — it's an ethical obligation under Opinion 512.
Enterprise agreements only. Consumer AI accounts (free ChatGPT, personal Copilot) are off-limits for client work. Enterprise versions with Business Associate Agreements, confidentiality protections, and data handling guarantees are the baseline.
Human approval gates. AI generates drafts. Humans review and approve. Nothing goes to a client, opposing counsel, or court without attorney review. This is non-negotiable in any responsible AI workflow.

Medical record summarization: AI can compress 500-page medical records into structured chronologies in a fraction of the time. Enterprise tools with HIPAA-compliant processing make this safe and dramatically faster.
